1. Introduction

Welcome to SharedOasisCenter ("we," "us," or "our"). These Terms & Conditions ("Terms") apply to your use of our yacht charter services as well as our website at sharedoasiscenter.sbs (the "Service"), which is managed by SharedOasisCenter.

When you make a charter reservation or use our Service, you consent to these Terms. If you do not agree with any part of these Terms, you should not use the Service.

2. Service Overview

SharedOasisCenter offers top-tier yacht charter services which include, among other things:

• Daily yacht rentals
• Evening cruises
• Business retreats
• Exclusively arranged events
• Long-term charters

Our services are always contingent upon availability and favorable weather conditions. We hold the right to change or halt services at any point in time.

3. Booking and Reservations

3.1 Reservation Process

For charter reservations, you are required to:

• Be of 18 years or above
• Provide valid and comprehensive details
• Adhere to the payment of the specified deposit mentioned in your reservation confirmation
• Accept these Terms & Conditions

3.2 Confirmation

A booking is only secured after we have received your payment and sent a formal acknowledgment. We have full discretion to deny service to any individual.

3.3 Charter Availability

Our chartered yachts are available depending on vessel accessibility and appropriate weather conditions. We will do our best to accommodate your chosen dates and times for the charter.

4. Payment Conditions

4.1 Cost

All stated fees are in € and encompass applicable taxes, unless indicated differently. Prices may change at any given moment without prior notification.

4.2 Payment Schedule

• Deposit: 50% of the overall charter cost payable at the time of booking
• Full payment: Due 48 hours before the start of the charter
• Additional expenditures (where applicable): Payable upon completion of the charter

4.3 Payment Methods

We accept most major credit cards, bank transfers, and certified cheques. All payments are processed using secure and encrypted methods.

5. Cancellation and Refund Policy

5.1 Client Cancellations

• If canceled more than 72 hours prior to departure: A full refund less transaction fees
• If canceled between 24 to 72 hours before departure: Partial refund of 50%
• If canceled less than 24 hours before departure: No refund

5.2 Cancellations Due to Weather

Should the weather be declared unsafe by our captain, we will propose to:

• Reorganize your charter date to the next convenient time without an additional charge
• Issue a complete refund in case a reschedule is unattainable

5.3 Mechanical Failures

If there's a mechanical failure with the assigned vessel, an effort will be made to supply an appropriate alternative. If this isn't possible, you'll receive a total reimbursement.

6. Safety and Conduct

6.1 Safety Requirements

All passengers are expected to:

• Observe instructions from the crew
• Use the safety gear provided when necessary
• Disclose any health conditions that may impact their safety
• Stay within the designated areas aboard the vessel

6.2 Prohibited Objects

The following articles are forbidden on the yacht:

• Glass containers
• Illegal materials
• Weapons or similar hazardous items
• Alcohol consumption beyond a reasonable amount for enjoyment
• Pets (unless approved prior)

6.3 Behavior

Passengers are required to behave in a considerate way. If passenger conduct jeopardizes safety or detracts from the pleasure of others, we can end the charter without issuing a refund.

7. Liability and Insurance

7.1 Our Accountability

We are only accountable for the amount you've spent on the yacht charter. We bear no responsibility for:

• Personal injuries owing to the negligence of passengers
• Loss or damage to personal belongings
• Indirect or consequential damages, or punitive damages
• Delays triggered by weather or other circumstances we can't manage

7.2 Insurance Coverage

We maintain thorough insurance for our yachts and operations. It is your duty to secure your individual travel and personal insurance.

7.3 Risk Acknowledgment

Engaging in our yacht charter indicates your acceptance that these activities pose intrinsic dangers, and you agree to take personal responsibility for your safety.

8. Itinerary Changes

Itinerary, routes, or time schedules may be changed due to factors like weather, safety concerns, or operational necessities. We will strive to offer comparable alternatives whenever adjustments are made.

9. Force Majeure

We are not answerable for any disruptions, cancellations or changes prompted by events outside our control, which includes, but is not limited to:

• Extreme weather
• Natural catastrophes
• Government mandates
• Harbor closures
• Vessel breakdowns

10. Personal Data Management

Your personal data is managed in line with our Privacy Policy. By availing of our services, you consent to the collection and use of your details as outlined in the Privacy Policy.

11. Intellectual Property

The content found on our service, including text, imagery, logos, and visuals, is covered by copyright and trademark rights. You may not reproduce, circulate, or create works derived from our content without our explicit permission.

12. Law Applicability

These Terms are regulated by the laws of Monaco. Any disputes will be settled in the courts within Monaco, Monaco.

13. Term Amendments

We hold the authority to alter these Terms at any period. Such adjustments will be made public on our website along with the date of revision. Continuing to use our services means you accept the revised Terms.
